"Getting In, Getting Out, Getting Paid"
Attorney Jim King taught a continuing legal education seminar with the above title while Chair of the California State Bar's Legal Education Committee. The seminar was given in a number of locations, and then at the State Bar's annual convention, where it was voted the best course of the year. For 15 years, Mr. King taught it twice annually to all new Bar admittees under the purview of the San Diego County Bar Association. Needless to say, Mr. King is intimately familiar will all aspects of this course, which are fee agreements, withdrawal as counsel, and fee disputes.
Mr. King has drafted numerous fee agreements which cover almost every imaginable variant. He has drafted a million dollar "true retainer" agreement. He has testified as an expert witness about fee agreements (and their effects) on a number of occasions. He has reviewed over 500 of them, either as a Fee Arbitrator, consultant, or attorney drafting them for his own clients.
Mr. King can custom-tailor an ethical agreement to cover any lawful arrangement agreed upon by both attorney and client. He is also well aware of the changing laws in this area – and has observed that many agreements are found to be invalidated based on recent case law with which the ordinary practitioner is not necessarily familiar. Of course, Mr. King can also analyze an existing fee agreement in the context of a particular attorney-client relationship, and opine on its application to a particular issue.
Withdrawal as Counsel
Mr. King has advised both attorneys and clients as to the propriety of terminating an attorney-client relationship at a particular point in time. More importantly, he has guided attorneys through the withdrawal process, and has also advised clients how to respond when their attorney is seeking to withdraw. In addition, he assisted a Federal Judge in deciding a number of these motions while a law clerk, and has since been asked by at least one Judge for assistance in deciding a motion to withdraw.
Mr. King's experience in this area also includes litigating a legal malpractice case arising from an inartfully crafted motion to withdraw as counsel, arbitrating disputes between attorneys after one had withdrawn and another obtained an excellent result, learning the nuances of the law of attorney liens filed after withdrawal as counsel, and advising attorneys as to the financial consequences of withdrawing from a case.
